The following applies to all attendees.
Definitions
“You” means you once you have registered for the event.
“We”, “us” and “our” means or refers to Reality Flight Simulation, LLC and its officers, agents, representatives, etc.
“ZSE” refers to the Virtual Seattle ARTCC, an unincorporated not-for-profit organization which is a child-organization of VATUSA, a division of the VATSIM Network, and it’s management staff.
“Hotel” means the Shilo Inns and the Shilo Inn Portland Airport.
ADMISSION
We reserve the right to refuse any person admission to the Event, for any reason, in our sole discretion and to remove you. Any behavior that we determine to be inappropriate, or that the Hotel deems inappropriate, is among reasons which you may be removed. No refunds of registration fees or any other costs associated with your attendance and travel for the Event will be made.
If for any reason you’re unable to attend the Event, you may transfer the value of your paid registration to another individual. Note that the individual whom you transfer to will have register at the current rate and will only receive the value you paid as a credit towards their purchase.
Only those who are ZSE Home Controllers at the time of registration through the period until and included the Event, are entitled to the use of a special coupon for a $10 discount. Any individual using this code who is not entitled to its use is immediately subject to and hereby authorizes an additional charge.
No attendee is permitted to be under the age of 18 years. All attendees will be required to provide a government-issued ID upon check-in, and at any time requested by Us or the designated Event staff.
REFUNDS
Refunds will not be available for registration after June 10th. Cancellations before this date must be submitted by email to info@realityflightsim.com, and a full refund less $5 (due to card processing and handling fees) will be refunded. Cancellations made after June 10th, 2019 will not be eligible for a refund. This is due to deadlines we must meet to finalize the Event space requirements with the Hotel and the cost incurred in expecting the number of attendees registered.
Remember that Reality Flight Sim is already subsidizing the costs when you factor an average of $70+ per person cost just for the event space. That means that those who register and still don’t show are still causing us to lose money that could have otherwise been put to better use for others.
EVENT CANCELLATION
We hold sole discretion to postpone or cancel the Event at any time. You agree to hold harmless any liability to you for any losses that may result due to the postponement or cancellation of the Event. This includes any travel or hotel costs, etc. Should the event be canceled or postponed, all attendees are entitled to a full refund of there registration fees.
COMPUTER HARDWARE & TABLE SPACE
All attendees are only guaranteed to have at least a 4-foot wide standard tablespace. No additional guarantees can be made. However, we know many might have setups needing much more space than this and we will absolutely be flexible and reasonable as space permits, and we may have plenty of it. Please review the event details regarding the point of contact if you’re needing more table space.
FOOD, BEVERAGE & ALCOHOL
You understand that the Hotel has the sole right to control the sale or distribution of all food and drink within all areas of the Hotel property. You agree not to sell or distribute any food or drink without our written consent and the consent of the Hotel.
A strong policy restricting the consumption or possession of alcohol to persons under 21 years of age is in effect. If you are under the age of 21, you agree that you will not consume or have possession of any alcohol and will not engage in any activities restricted to individuals under the age of 21.
No attendee who is in possession of alcohol shall provide such to anyone who is or might be under 21 years of age. Any of these actions is a crime in the State of Oregon and doing so will result in any such individuals being required to be removed from the Event AND the Hotel immediately.
TOBACCO & MARIJUANA
The use and purchase of any tobacco products by anyone under the age of 21 is illegal in the State of Oregon as of 2019. Those under the age of 21 are prohibited from using, purchasing, or possessing any tobacco products restricted under the laws of the State of Oregon. You shall not provide such products to individuals under the age of 21.
The State of Oregon has legalized the recreational use of Marijuana to those over the age of 21. However, the consumption of any such products on the Hotel grounds and in public places remains illegal. In addition, Marijuana is still illegal in accordance with US Federal Law.
Any consumption by individuals on the Hotel grounds, while engaged in activities organized by Us for the Event, are subject to removal from the Event and Hotel, by either Our or the Hotel’s discretion. Those who carry odors of Marijuana may also be subject to removal from the Event to ensure we do not violate our agreements with the Hotel.
CONDUCT & STAFF
While it’s expected that all attendees will conduct themselves appropriately, we must also ensure that all attendees understand that they are to comply with any requests made by Our or the ZSE staff for the Event. All staff members of Reality Flight Sim and the Virtual Seattle ARTCC will be announced and provided upon arrival at the Event.
This may also include staff providing additional specific directions to all or individual attendees to ensure the safety of all individuals and personal belongings.
ADDITIONAL CHARGES
Any individual who elects for additional charges during registration understands that such election is binding should the provisions as stated be met. Specifically, this applies to the “3 Meals Saturday” election that may be made. The 3 Meals Saturday is per one individual attendee only. This election can only be revoked in accordance with the same provisions pertaining to refunds. Thus, if a refund is not applicable then the fees for any additional elections will be assessed.
LIMITATION OF LIABILITY
Your registration provides access to the Event and associated activities only. You understand that you are solely responsible for your personal belongings and possessions. This includes, but not limited to; desktop computers, laptops, cell phones, flight simulation hardware, and anything else brought to the event.
While your belongings and possessions may remain in the main Event space throughout the weekend, including overnight, and such space should be secure, you understand we provide no warranties or guarantees. The event space
You also agree that during the duration of the event you will not engage in any activity that would be in violation of the laws of the State of Oregon, or US Federal law. You also agree that your conduct and activities on the VATSIM Network will comply with the VATSIM Code of Conduct.
PHOTOGRAPHIC RELEASE
You understand that We, ZSE, and others occasionally take photographs and make video or audio recordings for many different purposes. All attendees hereby grant and convey unto Us and ZSE all right, title, and interest in any and all photographic images and video or audio recordings made by Us and ZSE during the Event, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
Our and ZSE’s designated staff reserve the right to limit or restrict photographs, video, and audio recordings at our sole discretion. While we generally will welcome those who wish to conduct ‘streaming’ on the web, some limits may be put in place to help ensure the security and privacy of other attendees. This will likely be based on specific circumstances and staff assessment.
RELEASE OF LIABILITY:
You agree to release and forever discharge Us and ZSE from any and all liability for personal injury, damage or death, to any person including you, and for any and all loss, injury or damage, however caused, whether or not such injury or damage is caused by, or can be attributed to the acts, failure to act, or negligence of Us or ZSE or any other attendee.
Your registration provides access to the Event and associated activities only. You understand that you are solely responsible for your personal belongings and possessions. This includes, but not limited to; desktop computers, laptops, cell phones, flight simulation hardware, and anything else brought to the event.
You hereby release and forever discharge Us and ZSE from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with your attendance at the Event and any other activity with Us and ZSE.
You expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Oregon and that this Release shall be governed by and interpreted in accordance with the laws of the State of Oregon. You agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. You affirm you have carefully reviewed each of the sections above, and fully understand the agreements contained therein. You acknowledge you have had the opportunity to consider the agreements and ask questions. You acknowledge that you are freely entering into this agreement and to engage in the Event upon these terms. You understand that by signing this agreement, You are releasing Us, ZSE, and all of their respective employees, staff, officers, and agents from any and all liability and legal responsibility for injury, damage or death connected in any way with Your participation in the Event, and You agree not to initiate any legal action against Us, ZSE or all of their respective employees, staff, officers, and agents for personal injury, damage or death. You understand that this release is also binding on Your personal representatives, heirs, executors, administrators, successors and assigns.
